Do You Need to Accurately Record the Proceedings of an Expert Conclave or a Joint Conference?

Expert conclaves or joint conferences are private meetings where expert witnesses in the same field of expertise confer and endeavour to reach an agreement. The experts are required to prepare a joint report, specifying matters agreed upon, not agreed upon, and any reasons for any disagreement, called a “joint report”. Often the conclave is facilitated by an experienced facilitator. It is highly unusual for lawyers, advisers, and clients to be permitted to attend a conclave.

An underlying objective that frames the referral of experts to conclave is to ensure the separation of legal practitioners and experts so that experts can uncover the real issues in dispute.

By requiring experts to conclave, they can refine the scope of issues that are not agreed on and narrow down those that are, thereby producing consensus at an early stage which can encourage settlement. The result can be a substantial cost saving to the parties, not only if the case settles, but also if it proceeds, as there is a decreased requirement of subsequent lengthy cross-examination if the matter proceeds to hearing.
